Privacy Policy for Insurance Claims Processing as a Green Card Correspondent and 4th Motor Directive Representative

Who are we?

"Marins International" AD (Marins), UIC: 207700815, registered at 40 Graf Ignatiev Str., Varna 9000, is a nominated Green Card correspondent, a representative under the 4th Motor Insurance Directive, and a representative for the settlement of subrogation motor-own-damages claims for a number of foreign insurers - clients of Marins. Lists of these insurers are published on the websites of the National Bureau of Bulgarian Motor Insurers (NBBAZ), the Guarantee Fund (GF), and the Council of Bureaux (COB). In connection with the exercise of this activity, Marins acts as a personal data controller.
Marins respects the right to personal privacy of all individuals. Whether we process your personal data in your capacity as an injured or aggrieved party, or as a party liable for the damage, you fall under the protection of this policy.

What information do we collect about you?

  • Information you provide to us directly: You may provide us with information containing your personal data through written correspondence, via email, by filling out forms, or by submitting documents related to proving a claim or legitimizing the receipt of insurance compensation. This data includes your name, home address, email address, telephone number, date of birth, photograph, gender, vehicle registration number, personal identification numbers, bank account number. In cases of claims involving medical expenses or claims for non-pecuniary damages, this also includes medical information, marital status, qualifications, set of work skills, employment history, data on financial status, salary, employment benefits, state benefits, assets, pensions, and other personal/family expenses.
  • Information we receive from other sources: We may receive information about you from third-party websites, including local motor insurance bureaus, the Guarantee Fund, anti-fraud databases, as well as from insurers, lawyers, law enforcement agencies, and other state or municipal authorities and hospital institutions. Data collection is lawful, relevant, and limited to the issue(s) related to the review of your insurance claim or the claim against you.


For what purpose and on what grounds do we use your data?


The data we process is essential for the review of insurance claims related to road traffic accidents. We limit ourselves to processing and storing data only insofar as it is lawful and relevant for investigating the matters of liability for the accident and for realizing the rights of the injured/aggrieved persons against the guilty perpetrators and other liable parties.

How will we use your personal data?

The information you provide to us or that we collect about you is used by us and by other local representatives of insurers solely for the purposes of reviewing your claims or realizing rights against your insurer or against you yourself, if you caused the traffic accident.


To whom is your data provided?

During claims processing, it may be necessary for your personal data or parts thereof to be shared not directly with the insurer, but with their local representative located at the place of the accident, for the purpose of processing and assessing the submitted claim. The majority of these representatives are members of the Van Ameyde International B.V. group, Einsteinlaan 20 2289 CC Rijswijk, Netherlands (https://www.vanameyde.com/offices/).


We may share your information with selected third parties, including:

  • Service providers and subcontractors, such as, but not limited to, automotive technical and medical experts;
  • National Bureau of Automobile Insurers;
  • State authorities, when we are required by law to do so. This includes disclosure to third-party-managed insurance claim databases used for fraud prevention, and regulatory bodies for the purposes of monitoring and/or enforcing compliance with regulatory rules and codes;
  • Any third party to whom we are obliged to disclose or share your personal data in order to comply with a legal obligation or to protect the rights, property, or safety of our company, companies within the Van Ameyde International B.V. group servicing insurer-clients, and other persons. This includes exchanging information with other companies and organizations for the purposes of fraud prevention, detection, and protection.


Do we transfer data abroad?

Given the nature of the activity, the data we collect from you may be transferred to and stored at a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for the local representatives of the client insurers. Such staff may be engaged in, among other things, the processing and review of claims on your behalf, the processing of your data, and the provision of support services. By sending your personal data, you agree to this transfer, storage, or processing.


Data Retention Period?

The data we collect from you will be processed for the purpose for which it was collected and will be stored during the processing and for the duration of the local statutory retention period following the completion of the data processing.


What are your rights?

You have certain rights regarding your personal data processed by us, and they are described in this section. We will ask you to provide proof of your identity before we can accept instructions to exercise your rights.

  • To request access to them: You have the right to access your personal data that we store in our database; this can be done by sending a Data Subject Access Request to administration@marins.bg.
  • To request their rectification if they are inaccurate: If you believe that the data we hold about you is inaccurate, you have the right to have it corrected.
  • To request their erasure: With some exceptions, you have the right to request the deletion of the personal data we hold about you.
  • To request their blocking (restriction of processing): You have the right to ask us to restrict the processing of your personal data stored in our database for the period necessary for us to correct the inaccurate data about you.

To request that we transfer your personal data to another person (data portability): You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format and to transfer those data to another controller.
For further information how to exercise your rights, please contact us on the details given at the beginning of this policy. We will handle your request and reply to you within 30 days from its receipt. Depending on the complexity of your request and the number of requests received we can prolong this period by two months, but you will be notified by us in the meantime.
